Enforcing the ban on cartels is one of the central tasks of the Bundeskartellamt and has been an integral element of cartel law since the Act Against Restraints of Competition (ARC) came into force in 1957. In combating cartels the Bundeskartellamt focuses first and foremost on so-called hardcore cartels. Hardcore cartels are in particular agreements between companies on the setting of prices or sales quotas and on market sharing. During the past few years the Bundeskartellamt has achieved significant results in this area. Two major examples are the uncovering of cartels in the power cable and the ready-mixed concrete sectors.
Hardcore cartels constitute serious restraints of competition. Their general effect is to force prices higher for the consumer which is why they are so highly damaging to the economy and society. They also impede free economic activity.
In March 2002 the Bundeskartellamt set up a Special Unit for Combating Cartels (SKK) to increase the quota of uncovered cartel agreements and to speed up proceedings. The task of the SKK is to assist the relevant Decision Divisions in the Bundeskartellamt in uncovering cartel agreements by deploying specialised personnel and material resources.
Furthermore, it is above all the main contact point for all those wishing to avail themselves of the Leniency Programme. According to this, companies involved in an illegal agreement can be entirely or partly exempted from a fine if they make a decisive contribution to uncovering a cartel and cease their anti-competitive behaviour.
